Tax Return Preparer Penalties: The New Rules
Audience: This course is designed for all professionals who prepare taxes or give tax advice to clients including CPAs, CFPs, enrolled agents, licensed tax practitioners, and attorneys. Level: Basic Description: New IRS preparer penalties include up to a $1,000 preparer penalty for a “tax understatement” if the return preparer lacked a “reasonable belief” in the correctness of the item’s tax treatment. The $1,000 penalty rises to as high as $5,000 if the IRS decides the understatement was “willful or reckless.” The IRS has raised the stakes for taking aggressive tax return positions. This course examines the new rules, disclosure requirements and common traps for preparers. Learn About: The revised Circular 230 » Who, exactly, is a return preparer » The “reasonable belief” and “reasonable possibility” standards » What is “substantial authority” » Other preparer penalties » Suspension from practice before the IRS » The taxpayer’s standard » When disclosure on Form 8275-R is required » Dishonest return preparers » Common scams » 2007 and 2008 statutory changes » and How to spot potential problem clients. Instructor: Jim Jurinski, Attorney/CPA (Oregon and Washington). * Credit varies by profession. Please see our page on Professional CPE Requirements. ** Take two courses together and save $55.00.
